On Thursday, Capitolwire.com reported Justice Eakin asked the Judicial Conduct Board to cease its investigation of his emails and instead send the case to the Court of Judicial Discipline.
“In an effort to alleviate any mistrust of the process, I have asked the Judicial Conduct Board to forgo further deliberation of this matter, and remove the matter to the Court of Judicial Discipline immediately,” Eakin said in a statement.
The usual process is for the Judicial Conduct Board to make a recommendation to the Court of Judicial Discipline, however, questions were raised about the review done by the Board’s counsel Bob Graci who served on Justice Eakin’s reelection campaign in 2011.
